Sporty Funder - Terms of Use
The terms below are designed to serve as a guide to any "user" of our website(s). They outline the conditions that must be complied with by any user of this website and forms a legally binding agreement between Sporty Funder and the third party ("service User"). Whenever you use our services, you confirm that you agree to be bound by our Terms and acknowledge any changes to them.
We may from time to time, change, amend or alter some parts or whole of the Terms and conditions, which will be made effective immediately. Once these are done, they will be posted on our website for the information of all users. If you fail to agree these Terms and conditions, please do not use our website or any of our affiliate websites.
These Terms include our Private Policy (www.sportyfunder.com/privacy), policies and procedures published from time to time on the website.
The Terms
1.0 Eligibility
1.1 Our services are available to all individuals who are 18 years old and above, who can be the subject of a contractual agreement with a third party. Sporty Funder may, using its discretion, decline to offer services to any service user or may decide at any time to change its criteria for service provision without recourse to any individual.
2.0 Accessibility
2.1 Sportyfunder is available to all users as per 1.1(above). However, we reserve the right to modify, replace, change, suspend or in fact, discontinue its services by mass announcement at the website or through individual contact details. Sportyfunder also reserves the right to restrict, delete or deny access to individuals or service users who blatantly disregard our Terms of Use, either through the production, replication or introduction of any material, content or activity that is deemed as being contrary to the principles, values and ethos upon which this website is formed.
2.2 A Service User may browse the website without necessarily registering their personal details. However, as a condition of usage by individuals wishing to use the website as a platform for business conduct in the raising of finance, etc, it is a condition of the Terms of Use to register with Sportyfunder and select a screen name and password. Failure to provide complete, accurate and updated information shall constitute a breach of the Terms of Use, which will result in the instant termination of the individual/groups/organization's account.
3.0 Rules of Conduct
3.1 All project owners and project backers are responsible for their own activity in relation to these services. For this reason, Sportyfunder is in no way, manner, form or shape, responsible for user submissions, videos, audio clips, written forum comments, information, data, text, photographs, software, scripts, graphics and interactive features generated, provided or otherwise made accessible by Sportyfunder or any of its partners on or through the services provided.
3.2 By using the website, you promise to abide by all Terms of Use and not to use it for any purpose that is prohibited by the Terms of Use. For the avoidance of doubt, Sportyfunder does not encourage and will do anything possible to ensure that materials and information posted on the website are genuine, authentic and original from the source. Service users are not permitted to:
- infringe any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty;
- submit information that they knowingly are aware to be false, misleading, untruthful or inaccurate;
- submit material or information that is unlawful, threatening, abusive, harassing, defamatory, slanderous, deceptive, fraudulent, invasive of another person's privacy, etc.
- Submit unsolicited or unauthorized advertisement or promotional material or any material deemed to be spam, junk or virus-prone which has the effect of disrupting, damaging, limiting or interfering in the use of information and contents on the Site.
4.0 Guarantee of the content of the website.
4.1 Sportyfunder does not guarantee that any content or submissions made by any service user(s) will be made available. Sporty Funder is not obliged to monitor the website, its contents and user submissions, although, for the sake of integrity of information, we reserve the right to edit, delete, remove or modify any content at our sole discretion, without recourse to the service user.
5.0 Funding for Projects
5.1 Sportyfunder is a borderless way of bringing sports athletes and sports enthusiasts together to raise finance for sports and its related activities via a single, global platform. It is the policy of Sportyfunder not to receive, hold or keep any monies intended for project owners. All pledges are not redeemed until the target limit is reached. As such, Sportyfunder does not hold any funds of project backers.
5.2 Sportyfunder will not become liable for any transactions, dealings and or interactions with any organizations and/or individuals found on or through our services. This includes, but is not limited to the delivery of goods and services, and any other terms, conditions, warranties or representations associated with listings on Sportyfunder or any of its affiliate websites. As a platform for sports fans we are under no obligation to resolve disputes between any parties. However, all parties seeking funding must comply with the Terms of use associated with listing on our website. Sporty Funder reserves the right to cancel any organization/group or individual' listing if it is found to be in contravention with the Terms and conditions of use.
5.3 It is inevitable that there will be occasional failure of some credit cards; Sportyfunder cannot guarantee the full receipt of the targeted amount. Individuals/groups/organizations may initiate refunds at their own discretion. Sporty Funder does not issue refunds nor is it responsible for doing so.
6. Fees, Payments and Refunds
6.1 Sportyfunder does not charge fees from project backers.
6.2 No fees are charged for listing your project on the site.
6.3 Funds on Sportyfunder and its affiliate websites are initially pledged and are not collected by project owners until they have reached their funding goal.
6.4 Pledges are collected and funds processed and transferred within 14 days, to the project creator's bank accounts.
6.5 Sportyfunder does not refund any monies collected through our platform. Project owners may return funds to backers at their own discretion. Project owners are therefore responsible for delivery of the terms of their projects. Sporty Funder is not liable for delivery of these projects.
6.6 Unsuccessful projects, i.e. projects that do not meet their funding goal within the deadlines set will be cancelled and no pledges will be collected.
6.7 For projects reaching 100% of their target funding goal, a fee of 5% of the total funding received is charged. For projects that reach a minimum of 75% , but not up to 100% of their funding goal, a fee of 9% is charged.
6.8 All payments may be subject to credit card and transaction cost of 3-5% depending on the payment processing facility used.
7.0 Third Party Services
7.1 Sportyfunder does not provide any others services. However, our associates and partners may charge fees for their services. When you use a service that has a fee, you have an opportunity to review and accept the fees that you will be charged, which we may change from time to time.
7.2 You are responsible for paying all fees and applicable taxes associated with your use of the website. In the event a listing is removed from the service for violating the Terms of Use, all fees paid will be non-refundable, unless in its sole discretion, Sporty Funder determines that a refund is indeed, appropriate.
7.3 Where ever Sporty Funder permits you to link to other websites or resources on the internet, you do so at your own risk. Sporty Funder will not be liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. At the same time, Sportyfunder will not and cannot be held liable, directly or indirectly, for any damage or loss caused.
8. Content and License
8.1 All users must, to all intents and purposes, agree that the services provided by Sportyfunder and its partner companies are protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any content accessed through the Service.
8.2 Sportyfunder grants each user of the website and/or Service a worldwide, non-exclusive, and non-transferable license to use, modify and reproduce the content, solely for personal, non-commercial use. Use, reproduction, modification, distribution or storage of any content for other than personal, non-commercial use is expressly prohibited without prior written notice, which may not be unreasonably withheld. You shall not sell, license, rent, or otherwise use or exploit any content for commercial use or in any way that violates any third party right.
9. Copyright Notifications
9.1 Sportyfunder respects the intellectual property of its original owners. For this reason, we require others to observe our rights to intellectual property too. Sportyfunder may, in appropriate circumstances and at its discretion, terminate the accounts of users who infringe the intellectual property rights of others. Sporty Funder owns and holds the intellectual property rights in this website, including all materials published on it.
9.2 All service users are prohibited from making copies either electronically or by printing, downloading or otherwise, any part of the Site, unless they have the express authority of Sporty Funder. A breach of this rule will result in cessation of your rights to use our Site.
10. Warranty Disclaimer
10.1 Sportyfunder does not, in any way, form or shape, set itself out in a special relationship with you or any individual/group/organization, in relation to the provision of services. We only have control over materials and contents provided by the website; we bear no responsibility for third party information, content or materials provided on the website.
10.2 For these reasons, we do not provide any guarantees, conditions or warranties with regards to the accuracy or otherwise of these materials. We expressly exclude:
- All conditions, warranties and terms, either implied by statue, common law or other;
- All liabilities emanating from use of the website and resulting in direct, indirect, or consequential loss or damage to the user or third parties for loss of income or revenue, business, profits or contracts, data , goodwill, etc.
11. Policy on Computer Misuse
11.1 All users of sportyfunder.com must not misuse it by knowingly introducing or causing other third parties to introduce harmful materials such as viruses to cause disruption or halt the services provided by Sporty Funder.
11.2 All unauthorised access to prohibited websites or access to information/data forbidden by users and third parties shall be deemed as a criminal offence under the Computer Misuse Act 1990. Any such breach may lead to prosecution by the authorities involved.

13. International
13.1 Sportyfunder.com is a worldwide platform for all sports fans. The website can be accessed from anywhere in the world. However, local laws in the user's country apply and must be respected.
